1. Merchant of Record
Purchases of LevelUp licenses are processed by Polar, which acts as the Merchant of Record (reseller) for the transaction. This means Polar is the contracting party for payment, invoicing and tax, and processes all refunds on our behalf. Product support, license delivery and the contractual service itself are provided by LevelUp Software Development (Sinan Fischer).

If you are a consumer, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (LevelUp Software Development, Sinan Fischer, c/o POSTFLEX PFX-343-277, Emsdettener Straße 10, 48268 Greven, Germany; email sinan@levelupvscode.com) of your decision by a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
3. Digital Content and Your Right of Withdrawal
LevelUp licenses are digital content not supplied on a tangible medium and are made available for immediate use. Under § 356 (5) of the German Civil Code (BGB) and Art. 16(m) of the EU Consumer Rights Directive 2011/83/EU, a trader may ask you to expressly consent to provision beginning before the end of the withdrawal period and to acknowledge that you thereby lose your right of withdrawal.
We do not ask you to waive that right. Your statutory 14-day right of withdrawal therefore applies in full, even though your license key is delivered immediately after purchase. If you withdraw within 14 days, you receive a full refund and your license key is deactivated.
4. Consequences of Withdrawal
If you validly withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed of your withdrawal. The reimbursement is carried out by Polar as our Merchant of Record. We will use the same means of payment you used for the original transaction unless expressly agreed otherwise; you will not incur any fees as a result of the reimbursement.

6. Refunds
All refunds are processed by Polar as Merchant of Record. To request a refund or to raise any billing issue, contact us at sinan@levelupvscode.com or use the customer portal linked in your Polar order confirmation email. Beyond the statutory right of withdrawal described above, refunds for digital content already provided are granted at our discretion.
7. Subscriptions, Renewal & Cancellation
LevelUp Cloud is a subscription, billed either yearly or monthly, that renews automatically at the end of each billing period for the then-current price until cancelled. LevelUp Local is a one-time purchase and does not renew. You can cancel at any time with effect from the end of the current billing period via the customer portal linked in your Polar order confirmation email, via our cancellation page, or by contacting sinan@levelupvscode.com. After cancellation you retain access to the paid features until the end of the period already paid for. No partial refunds are given for the remaining days of a started billing period, unless required by mandatory law.
When you cancel LevelUp Cloud with yearly billing, your contract converts into a LevelUp Local plan at no further charge. From the end of the paid year, the cloud features stop and your right to use the local functions, including their future updates, continues without a time limit. With monthly billing there is no such conversion; all access ends when the cancellation takes effect.
